Thank you CrashFrog for bringing reason to the conversation. To the rest of you the IRS has specific guidelines for who can qualify as a Salaried Exempt employee and many, many companies have lost large labor lawsuits and had to pay restitution to their employees.
"IT" employees that qualify for Salaried Exempt are almost 100% restricted to Programmers. The reasoning behind the exemption is that it is difficult to place a time restriction on what a programmer does, when they work and are effective, so the exemption is allowed in that case, however the exemption cannot apply to someone who has a component of time attached to their work, like ANY employee who works on the systems, if you are required to respond on a set (or regular) schedule you ARE NOT EXEMPT. Salary is not an excuse or method for a company to fill 2 positions with 1 employee.
There is a good reason why Lawyers take these cases and courts rule so quickly on them - IT IS ILLEGAL!!!
Though I do not really know why this is news, and it will suck if the result makes my next MAC more expensive, but I would rather Apple was responsible than I saved $5.
